By checking the consent box on the Challenge application and/or by submitting any photo, video, image, audio, or text (collectively, "Content") to the Pup Choice Coat Glow‑Up Challenge, I ("I," "me," "my") agree to this Content & Likeness Release (this "Release") with Brainiac Brands Inc., doing business as Pup Choice ("Pup Choice").
I grant Pup Choice and its parent, affiliates, successors, licensees, and assigns a perpetual, irrevocable, worldwide, royalty‑free, fully paid‑up, transferable, and sublicensable license to use, host, store, reproduce, edit, crop, adapt, modify, combine with other materials, publish, distribute, publicly display and perform, and create derivative works from my Content, and to use my first name, my dog's name, image, and likeness, and my own name, voice, image, and likeness to the extent they appear in the Content — in any and all media now known or later developed, including advertising, paid social and search ads, organic social media, websites, email, landing pages, packaging, and point‑of‑sale — without any further notice to me, and without review, approval, or compensation.
I keep ownership of my original Content; this Release is a license, not a sale or assignment, of my Content. Pup Choice owns any new creative, edits, or composite works it produces using my Content.
I represent and warrant that:
I understand and agree that I will not be paid for Pup Choice's use of my Content. My participation in the Challenge — including receiving free product and being eligible for the prize — is the full and complete consideration for the rights I grant here.
To the fullest extent permitted by law, I waive any right to inspect or approve how Pup Choice uses the Content, and I waive any "moral rights" in the Content. I release Pup Choice and its affiliates and their respective personnel from any and all claims arising out of the use of the Content, including claims for invasion of privacy, violation of the right of publicity, defamation, false light, or copyright/trademark infringement.
Any opinions or statements in my Content reflect my honest, genuine experience. I understand that individual results vary and are not typical or guaranteed. I received free product, which creates a material connection with Pup Choice; if I post about Pup Choice or the Challenge, I will clearly disclose that connection (e.g., #ad, #PupChoicePartner), consistent with FTC guidelines.
This Release is perpetual and survives the end of the Challenge. As a courtesy, I may ask Pup Choice to stop using my Content in newly created materials going forward by emailing woof@pupchoice.com; however, Pup Choice is not required to recall, edit, or remove materials already produced, published, distributed, or placed as ads.
This Release is governed by the laws of the State of Delaware. If any part of this Release is found unenforceable, the rest remains in full force and effect. This Release is binding on my heirs and successors.
